Legal and Sworn Translations

In contrast to any ordinary translation, sworn translations must be duly stamped, signed and stamped.  The stamp beared is the one by the official translator appointed by the Ministry of Foreign Affairs and Cooperation. If you have never done sworn a translation, I suggest you read this post to help you in your professional work.

First of all we must follow the conventions that stipulate the “translation rules” lernt at university. Then we can move on to the second phase, which is to give legal validity to the document. We follow these four simple steps:

1) Include the official certification (included in the last page of the translation)
Mr/Ms ……………………………… (name and surname), in my capacity as a sworn translator (language), I hereby certify that this translation into (target language) is complete and accurate to the original document written in ( source language), and in witness whereof I hereunto set my hand and official seal.

In …… .. (place), to …………… (date).

Signature

2) Seal the translation (remember that all pages must be stamped and signed)
(NAME AND SURNAME)
Sworn Translator / Interpreter / of (LANGUAGE)
No. (NUMBER OF SWORN TRANSLATOR/INTERPRETER)

3) Sign the translation

4) Print the translation on either stamped status paper or on white paper.

Sworn translation of academic certificates

Is machine translation reliable?

To be a good translation professional it is crucial that we specialise in a field and a language combination in which we have full mastery. In my case, I specialised in legal and sworn translation with the following combinations: English-Spanish, Spanish-English. Translating a divorce complaint, a will, a lease, as you may know, is not just about translating literally and making sure the grammar is correct. There is a much deeper analytical work that we need to know. In the medical field, we have “no more” exact equivalents of terms. The origin of Latin words helps us enormously when translating medical reports. If we look at the medical specialties in Spanish and English they are very similar: pedriatrics (pedriatría), traumatology (traumatología) or psychiatry (psiquiatría). This should not mean that there is no complexity, in my case I also do sworn translations of medical reports, and sometimes it is very laborious to find the equivalent in the target language. There are terms that are not in the dictionary, so you have to look elsewhere.

As we said in our title, is machine translation reliable? For a legal context, absolutely not, as we must not only know the terms. We need to have some idea of the legal system of the countries of origin and destination. This applies to English-speaking countries such as England, the United States, Ireland, New Zealand and others. In Spain, we apply the Common Law and the Civil Law. What does this mean? There are legal figures in one country that do not exist in another. Such is the case of the term “procurador“. This figure does not exist in English law and therefore can be very laborious to translate. For me, the last time I was involved in a divorce complaint I chose to use the term “representative agent” and in addition to this, I chose to insert a footnote at the end of the sworn translation detailing the role of the procurator in Spain.

There are other terms that can lead to confusion such as those that appear in the following table:

My recommendation is that when we accept a translation assignment, before quickly sending the quote, we should look at the legal aspects and not simply at the number of words to be translated. It is not the same to translate a text that has to take effect in the same legal system as one that has to be adapted to the target country, as the working time will always be longer.
